BY ACCESSING THIS WEBSITE, REGISTERING FOR A TRAINING PROGRAMME, OR ENTERING INTO A SERVICE AGREEMENT WITH US, YOU AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS AND OUR PRIVACY POLICY. IF YOU DO NOT AGREE TO THESE TERMS, PLEASE DO NOT USE OUR WEBSITE OR SERVICES.

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User", "Client", or "you") and Pristine CyberIntel Private Limited ("Pristine CyberIntel", "we", "our", or "us"), a company incorporated under the Companies Act, 2013, with its registered office at 305-B, Town Centre II, Marol, Andheri-Kurla Road, Andheri (East), Mumbai - 400059, Maharashtra, India.

1. Definitions

In these Terms, unless the context otherwise requires:

  • "Agreement" means these Terms and Conditions together with any applicable Statement of Work, Service Agreement, or Training Enrolment Form.
  • "Confidential Information" means any non-public information disclosed by one party to the other, whether in written, oral, electronic, or other form, that is designated as confidential or that reasonably should be understood to be confidential given the nature of the information.
  • "Intellectual Property Rights" means all patents, copyright, database rights, trade secrets, trade marks, service marks, design rights, and any other intellectual or industrial property rights, whether registered or unregistered.
  • "Services" means IT security training, IT security audits, vulnerability assessments, penetration testing, cyber crime investigation, digital forensics, IT outsourcing, managed IT infrastructure services, consultancy, and all other services offered by Pristine CyberIntel.
  • "User" means any individual or entity accessing the website or availing any Service.
  • "Website" means https://pristinecyber.com and all associated pages and subdomains.

2. Acceptance and Eligibility

By accessing the Website or availing any Service, you represent and warrant that:

  • You are at least eighteen (18) years of age, or are accessing the Services with the consent of a parent or legal guardian.
  • You have the legal capacity to enter into a binding agreement under applicable Indian law.
  • If accessing on behalf of a company or other legal entity, you have the authority to bind that entity to these Terms.
  • Your use of the Website and Services complies with all applicable laws and regulations.

We reserve the right to refuse access to the Website or Services at our sole discretion, without notice.

3. Services

3.1 Scope of Services

Pristine CyberIntel provides the following categories of services:

  • IT Security Training: Including CISEH, CPTE, CCEI, ISO/IEC 27001 Lead Implementer/Auditor, GDPR Data Protection Officer, Certified Android Application Developer, and other programmes delivered online, in classroom, or in a corporate setting.
  • IT Security Audit: Vulnerability assessments, penetration testing, security posture evaluations, and risk mitigation consulting.
  • Cyber Crime Investigation: Digital forensics, incident response, evidence collection, and legal support services.
  • IT Outsourcing: Managed IT infrastructure, systems integration, NOC setup, cloud migration, and 24/7 support.
  • Consultancy and Advisory: Cyber law consulting, compliance advisory, and information security governance.

3.2 Service Agreements

All Services shall be governed by a separate written Statement of Work, Service Level Agreement, or Training Enrolment Form executed between the parties, which shall be read in conjunction with these Terms. In the event of any conflict, the specific Service Agreement shall prevail over these Terms.

3.3 Modifications to Services

We reserve the right to modify, suspend, or discontinue any Service (or any part thereof) at any time with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of Services, except as may be expressly set out in a binding Service Agreement.

4. Training Programmes

4.1 Enrolment

Enrolment in any training programme is subject to seat availability and payment of applicable fees. Confirmation of enrolment will be provided upon receipt of full payment or as per the payment terms agreed in writing.

4.2 Fees and Payment

Training fees are as displayed on the Website or as quoted in writing. All fees are exclusive of applicable GST unless otherwise stated. GST at the applicable rate shall be charged additionally. Payments are to be made by bank transfer, demand draft, or other methods as specified at the time of enrolment. All fees are quoted in Indian Rupees (INR) unless expressly agreed otherwise.

4.3 Cancellation and Rescheduling

  • Cancellation by Participant: Cancellations made more than 15 days before commencement: 10% deduction. Cancellations 7–15 days before: 25% deduction. No refund for cancellations less than 7 days before or for no-shows.
  • Rescheduling by Participant: Requests must be made in writing at least 10 days before the programme start date. One rescheduling permitted per enrolment subject to seat availability.
  • Cancellation by Pristine CyberIntel: We reserve the right to cancel or reschedule due to insufficient enrolment, trainer unavailability, force majeure, or other operational reasons. Participants will be offered an alternative date or full refund.

4.4 Certification

Certificates are issued upon successful completion of the programme, including attendance requirements and, where applicable, passing assessments. Certificates remain the intellectual property of Pristine CyberIntel and are issued subject to verification of participant identity. Fraudulent use of certificates will be reported to appropriate authorities.

5. Fees, Invoicing, and Payment Terms

For professional services, fees shall be as agreed in the applicable Service Agreement. Unless otherwise agreed:

  • Invoices are due and payable within thirty (30) days from the date of invoice.
  • Late payments will attract interest at 18% per annum, or the maximum rate permissible under applicable law, whichever is lower.
  • We reserve the right to suspend Services in the event of non-payment of undisputed amounts.
  • All payments must be made in Indian Rupees unless otherwise agreed in writing.

6. Intellectual Property Rights

All Intellectual Property Rights in and to the Website, training materials, course content, methodologies, tools, software, reports, and all other materials created or developed by Pristine CyberIntel ("Pristine IP") are and shall remain the exclusive property of Pristine CyberIntel or its licensors.

Subject to your compliance with these Terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the training materials and Website content solely for your own personal or internal business purposes. This licence does not include the right to copy, reproduce, distribute, modify, sub-licence, sell, or use Pristine IP for commercial training or resale purposes.

7. Confidentiality

Each party agrees to hold in strict confidence all Confidential Information of the other party and not to disclose such information to any third party without prior written consent. This obligation shall survive termination for a period of five (5) years.

8. Authorised Use and Prohibited Conduct

You agree to use the Website and Services only for lawful purposes. You shall NOT:

  • Use the Website or Services for any unlawful purpose or in violation of applicable law including the Information Technology Act, 2000;
  • Transmit unsolicited commercial communications (spam);
  • Upload or distribute viruses, malware, or any code designed to disrupt or damage systems;
  • Attempt to gain unauthorised access to any part of the Website or our systems;
  • Engage in data mining, scraping, or automated data collection without our express written consent;
  • Impersonate any person or entity;
  • Use knowledge, tools, or techniques from our training for offensive cyber activities against systems without explicit written authorisation.

We reserve the right to immediately terminate your access in the event of any violation.

9. Disclaimers and Limitation of Liability

THE WEBSITE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND. We do not warrant that the Website will be uninterrupted, error-free, or free of viruses.

Our Services and training programmes are provided for general information and professional development. No information or advice constitutes legal advice. For specific legal matters, consult a qualified legal professional.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE INDIAN LAW, IN NO EVENT SHALL PRISTINE CYBERINTEL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. Our aggregate liability for direct damages shall not exceed the fees paid by you in the three (3) months immediately preceding the event giving rise to the claim.

You agree to indemnify, defend, and hold harmless Pristine CyberIntel from and against any claims arising out of your violation of these Terms or your use of the Services.

10. Third-Party Links

The Website may contain links to third-party websites. Such third-party services are subject to their own terms and privacy policies. We are not responsible for the content or practices of any third-party website.

11. Force Majeure

Neither party shall be liable for any delay or failure to perform caused by circumstances beyond its reasonable control, including acts of God, natural disasters, epidemics, war, civil unrest, government action, strikes, power failures, or internet outages.

12. Term and Termination

These Terms remain in effect for as long as you use the Website or engage our Services. We may terminate or suspend your access without prior notice if you breach any of these Terms. Clauses 6, 7, 9, 13, and 14 shall survive termination.

13. Governing Law and Dispute Resolution

These Terms shall be governed by the laws of India. Disputes shall first be resolved through good-faith negotiations within thirty (30) days. If not resolved, disputes shall be referred to arbitration in accordance with the Arbitration and Conciliation Act, 1996. The seat and venue of arbitration shall be Mumbai, Maharashtra. The courts at Mumbai, Maharashtra, India shall have exclusive jurisdiction.

14. General Provisions

These Terms, together with the Privacy Policy and any applicable Service Agreement, constitute the entire agreement. If any provision is found unlawful or unenforceable, it shall be severable. We reserve the right to amend these Terms at any time by posting the revised version on the Website. Your continued use constitutes acceptance of the revised Terms.
